The Policy Conformity Flag is a simple and clear tool that allows all interested parties to determine which LEI records (i.e., the set of data related to an LEI code) meet certain Regulatory Oversight Committee (ROC) policies. The ROC coordinates and oversees the Global LEI System. An LEI record marked as ‘conforming’ indicates that the following criteria are met:
  • The LEI registration is up-to-date - the LEI record renewal (and thus, the review of data related to the legal entity) has been completed within the specified timeframe.
  • The declaration of corporate structure data is complete - the legal entity has provided data regarding direct and ultimate parents (or has provided one of the specified reasons why such data may not be provided).

The transfer to InfoCamere can be requested only for LEI codes assigned to entities with Italy, Germany, Luxembourg and the United Kingdom as their jurisdiction of formation. The transfer of codes in "issued" or in "lapsed" status can be requested. The transfer of LEI codes in "retired" status cannot be requested.

Renewal can be requested starting 60 days before the expiration of the LEI Code and at the same time it is possible to choose whether to opt for a One-Year or Three-Year Plan. One day after expiration, if not renewed, the LEI Code will be expired and no longer usable until the next renewal. To find out the expiration date of the LEI Code, you can access the ID LEI site and use the SEARCH BY LEI CODE/COMPANY NAME function.

You can request the LEI code certification during the activation or renewal phase of the LEI code in question. When choosing a Three-Year Plan, you will get the LEI certification for free and it will be sent to you every year during the Three-Year Plan. You will find the Certificate attached to the e-mail confirming the processing of the renewal request.

As of May 1st, 2017, applying for or renewing an LEI code requires certain information regarding the applicant's corporate structure, with the aim of increasing transparency in financial markets. The LEI system introduced internationally a requirement to expand the information associated with a code with data on the relevant corporate structure. For more details see GLEIF (Global Legal Entity Identifier Foundation). In cases where the applicant belongs to a corporate group (and is not the parent company), the application for activation or renewal of the code must be supplemented with master information on the direct consolidating entity and the parent company and with the submission of the latest consolidated financial statements. The Direct Consolidating Entity is the lowest-ranking entity in the Corporate Group, which prepares the consolidated financial statements and includes the entity requesting/renewing the LEI code in its consolidation scope. The Direct Consolidating Entity may not coincide with the Parent Company (Final Consolidating Entity). Instead, the Parent Company is the legal entity that exercises control over all subsidiaries and is required to prepare the Consolidated Financial Statements. MIFID II is the community directive 2014/65/UE on markets in financial instruments and MIFIR is the related implementing regulation (600/2014). In order to develop a single European market for financial services, the legislation above has among its main objectives the increase of market transparency and of their supervision, the protection of investors and the improvement of transaction execution strategies. EMIR is the regulation n. 648/2012/UE that made it mandatory to report to competent supervisory authorities the details concerning operations carried out in derivative financial instruments (whether referring to products listed on regulated markets or OTC markets).
